1. INTRODUCTION

These Terms and Conditions ("Terms") govern the participation of any individual ("Member", "Distributor", or "Participant") in the business system operated by Hari Om Saayin Marketing Private Limited ("Company").

IMPORTANT NOTICE

By registering, purchasing products, or participating in the Company's business model, you agree to comply fully with these Terms. The Company operates a product-based, franchise-oriented business model, and not an illegal pyramid or money circulation scheme.

2. ELIGIBILITY & ENTRY CONDITIONS

Entry into the Company's system is permitted only after purchasing a Health Card priced at ₹649.

KEY REQUIREMENTS
  • The Health Card is mandatory and serves as the basic entry requirement for participation.
  • No participation, income eligibility, or business activity is allowed without a valid Health Card.
  • The Health Card provides access to our wellness products and business opportunities.

3. MOBILE NUMBER & FAMILY ENTRY POLICY

To maintain system integrity and prevent misuse, the following policies are strictly enforced:

  • A maximum of three (3) IDs may be created using one mobile number.
  • Within a family, only one ID per family member is permitted.
  • Any attempt to create multiple or fake IDs using the same person's identity, documents, or manipulation of family details will be treated as a serious violation.
STRICT ACTION POLICY

If any irregularity, fraud, or misrepresentation is found:

  • The concerned IDs will be immediately cancelled without notice.
  • No compensation, refund, or income will be paid for cancelled IDs.
  • The Company will not be held liable for any loss arising from such cancellation.

4. WORKING MEMBERS FROM THE SAME FAMILY

If another family member wishes to actively work in the Company:

  • They must submit a separate application with valid Aadhaar Card and PAN Card.
  • Such applications will be placed under strict surveillance for a period of 6 to 12 months.
SURVEILLANCE PERIOD CONDITIONS

During the surveillance period:

  • All activities will be closely monitored by our compliance team.
  • Any violation, duplication, or misuse will result in immediate termination.
  • The Company reserves full rights to approve or reject such applications without obligation to provide justification.

5. BUSINESS MODEL CLARIFICATION (FRANCHISE-BASED SYSTEM)

The Company operates on a franchise-based distribution model, similar in structure to established Indian businesses:

FRANCHISE MODEL DETAILS

Under this model:

  • Members act as independent franchise participants, not employees.
  • Products manufactured or marketed by the Company are sold through this franchise agreement.
  • Income is paid in the form of: Sales-based incentives, Bonuses, Dividends / performance rewards
  • All payments are strictly linked to product sales, network performance, and business volume, and not merely recruitment.

6. LEGAL COMPLIANCE & GOVERNMENT REGULATIONS

The Company operates fully within the legal framework of India. Our business model is designed to comply with:

  • Direct Selling Guidelines issued by the Government of India
  • Consumer Protection laws and regulations
  • Income Tax regulations and compliance requirements
  • All applicable state and central government laws
LEGAL OPERATIONS

Since franchise-based models are legally operational in India, the Company conducts its business under the same lawful principles. The Company is registered and operates as per all statutory requirements.

7. INCOME DISCLAIMER

IMPORTANT DISCLAIMER
  • The Company does NOT promise fixed or guaranteed income.
  • All earnings shown in presentations, dashboards, or examples are illustrative only and not guarantees.
  • Actual income may vary from person to person based on multiple factors.
  • Any misuse of income projections to mislead others is strictly prohibited and may lead to termination.

Earnings depend entirely on:

  • Individual effort and dedication
  • Sales performance and product knowledge
  • Team productivity and network growth
  • Compliance with company policies and terms

8. TERMINATION & DISCIPLINARY ACTION

The Company reserves the right to take disciplinary action including:

  • Suspend or terminate any ID without prior notice for violations
  • Withhold income earned through unethical or illegal means
  • Take legal action against fraudulent activities
GROUNDS FOR TERMINATION

Immediate termination may occur if:

  • Fraud, misrepresentation, or identity theft is detected
  • Policy violation or non-compliance with terms
  • Duplicate or fake identity usage
  • Legal non-compliance or unethical practices

9. NO REFUND & NO COMPENSATION POLICY

STRICT POLICY

Once an ID is terminated due to policy violation:

  • NO REFUND of any amount paid
  • NO COMPENSATION for any loss or damage
  • NO PENDING INCOME shall be payable
  • The Company shall not be responsible for losses caused due to the Member's own violation of Terms

10. MODIFICATION OF TERMS

  • The Company reserves the right to modify, update, or amend these Terms at any time without prior notice.
  • Changes will be effective immediately upon posting on our website.
  • Continued participation after changes implies automatic acceptance of the revised Terms.
  • It is the Member's responsibility to regularly review these Terms for updates.

11. FINAL DECLARATION

Your Acceptance of Terms

By joining Hari Om Saayin Marketing Private Limited, you confirm that:

  • You have read, understood, and agreed to these Terms in their entirety
  • You acknowledge that this is a business opportunity, not employment
  • You agree to operate ethically, legally, and transparently
  • You understand the risks and rewards of this business model
  • You accept complete responsibility for your business activities
